The process of buying and selling land and buildings is referred to as the conveyancing process. It involves the transfer of the legal title to that land or building from the seller to the buyer. We will ensure that the sellers own the property that they are selling to you and that there are no inappropriate restrictions registered against the title to the property that you need to know about. We will answer the questions and deal with the other requirements imposed by your mortgage lender to release your mortgage funding and we will ensure that the title to the land and buildings is transferred to you at the Land Registry at completion.
The conveyancing process is divided into stages that follow one another and end in legal completion. The first stage is the agreement of the sale between the seller and the proposed buyer, there then follows an investigation stage where we will obtain a copy of the seller’s title to the property and will ask them questions about their ownership of the property. Next follows the receipt of the mortgage offer (if you are having a mortgage) and the satisfaction of any conditions imposed by your lender. When these matters have been dealt with the “Exchange of Contract” occurs which is the stage when the sale becomes binding on both the buyer and the seller and the completion date is agreed and set. Legal completion then follows on the agreed completion date when all money changes hands and the title to the property is changed at the Land Registry.

When you agree to sell a property to a Buyer we will act swiftly to maximise your chances of completing that sale to that Buyer within your chosen timescale. We are very aware that Buyers are more and more difficult to find these days and therefore we will do everything we can to assist the Buyer with their enquiries and deliberations so that there are no obstacles in the way of a successful sale. In particular, we will obtain a copy of your legal title to your property and we will obtain a redemption figure for your mortgage from your Mortgage Lender (if you have one). We will then ensure that the sale documentation is structured in an efficient and effective manner and, most importantly, we will keep the pressure upon the Buyers’ Solicitors to give you the best chance of completing the sale on your chosen date.
